अरविंद केजरीवाल की अंतरिम जमानत पर सुप्रीम कोर्ट ने 7 मई को फैसला सुरक्षित रख लिया था। ईडी ने दिल्ली के मुख्यमंत्री की जमानत का विरोध किया था और कहा था कि चुनाव प्रचार के लिए जमानत मिलना मौलिक, संवैधानिक या कानूनी अधिकार नहीं है। कोर्ट ने ED की जांच पर भी सवाल उठाए थे। कोर्ट ने पूछा था कि चुनाव से ऐन पहले अरविंद केजरीवाल को क्यों गिरफ्तार किया गया। इसके साथ ही पूछा गया कि केजरीवाल के घर से क्या कुर्की की गई? इसके साथ ही कोर्ट ने ये भी पूछा कि जब आपकी कार्रवाई पहले से चल रही थी तो अरविंद केजरीवाल की गिरफ्तारी में इतना वक्त क्यों लगा?

सुनवाई के दौरान सुप्रीम कोर्ट ने कहा था कि ये स्थिति असाधारण है। पांच साल में एक बार चुनाव होते हैं और अरविंद केजरीवाल एक राज्य के मुख्यमंत्री हैं। कोर्ट ने ये भी कहा कि अरविंद केजरीवाल के खिलाफ कोई केस भी नहीं है।
